1.The Service is provided "as is"
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, accurate, complete, or error-free, or that location data, history, or any other output will be reliable or fit for any particular use. You use the Service entirely at your own risk.
2.No liability
To the fullest extent permitted by applicable law, we are not responsible or liable for any damages or losses of any kind arising out of or related to your installation, deployment, configuration, or use of (or inability to use) the Service. This includes, without limitation, direct, indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, revenue, goodwill, or devices; business interruption; or any other commercial or personal damages — even if we have been advised of the possibility of such damages.
Where liability cannot be excluded by law, our total aggregate liability for any and all claims relating to the Service is limited to the greater of (a) the amount you actually paid us for the Service in the three (3) months preceding the claim, or (b) USD $0 if the Service was provided free of charge.
3.Installation, deployment & devices
You are solely responsible for installing, deploying, and configuring the Service, including any use of Microsoft Intune, mobile device management (MDM), Managed Google Play, enrollment profiles, permissions, and device settings. We are not responsible for:
- any damage to, malfunction of, data loss on, or unavailability of any device;
- battery usage, data/network charges, or performance impacts;
- configuration mistakes, failed or partial deployments, or incompatibilities with your hardware, OS version, MDM, or vendor (e.g. Samsung Knox) behavior;
- whether tracking starts, continues, stops, or operates "zero-touch" on any given device — behavior varies by platform, vendor, and configuration and is not guaranteed.
4.Location data & privacy
The Service collects and displays device location and related information that you choose to send to it. You are solely responsible for your collection, use, storage, sharing, and retention of all data, and for ensuring it is lawful.
- You are responsible for complying with all applicable laws and regulations, including those governing location tracking, employee and workforce monitoring, surveillance, consent, data protection, and privacy (for example, GDPR, CCPA/CPRA, and similar laws).
- You are responsible for providing any required notices to, and obtaining any required consent from, the individuals whose devices or locations are tracked.
- We do not independently verify, and are not responsible for, the legality or appropriateness of any tracking you perform or any data you collect through the Service.
- Location data may be inaccurate, delayed, incomplete, or missing. Do not rely on it for safety-critical, emergency, or legal purposes.
You — not us — act as the controller/owner of the data you process through the Service and are responsible for honoring data-subject rights and requests.
5.Data security
No method of transmission or storage is completely secure. While we take reasonable measures, we cannot and do not guarantee the security of any data and are not responsible for unauthorized access, loss, alteration, or disclosure of data, however caused.
6.Availability & changes
The Service may be modified, suspended, limited, or discontinued at any time, with or without notice. We are not liable for any change to or discontinuation of the Service, or for any deletion of or failure to store data. Features, retention periods, and pricing may change at any time.
7.Acceptable use
You agree not to use the Service to:
- break any law or regulation, or infringe anyone's rights;
- track any person or device without the legal right and any required consent to do so;
- attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the Service or its infrastructure.
8.Your responsibilities & indemnification
You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your data, your deployment and configuration, or your violation of these Terms or any law (including privacy and tracking laws).
9.Third-party services
The Service may rely on or interoperate with third-party products and services (for example, Microsoft Intune, Microsoft Entra, Managed Google Play, map providers, and form/email providers). We are not responsible for third-party services, their availability, or their terms, and your use of them is governed by their respective agreements.
10.Termination
We may suspend or terminate your access to the Service at any time, for any reason, without notice or liability. The sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
11.Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date above reflects the current version.
12.Governing law
These Terms are governed by the laws of [your jurisdiction], without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there.
